Terms of Sale

These Terms of Sale govern sales made on the website https://coolkidsaudio.com, operated under the trade name "Cool Kids Audio" by Boring Vic SAS.

They apply to every order placed on the website. Before confirming an order, the customer declares that they have read and accept these Terms of Sale. This acceptance is confirmed by a checkbox at checkout.

2. Products

The products offered for sale are those presented on the website on the day the customer visits, subject to available stock.

Cool Kids Audio strives to present products as accurately as possible. Photographs and visuals are for illustration purposes; slight differences (color, accessories photographed for ambiance) do not engage the liability of Cool Kids Audio, subject to the legal conformity guarantees set out in article 8.

3. Prices

Prices displayed on the website are in euros (€), including all taxes (VAT), excluding shipping costs.

Applicable shipping costs are shown to the customer before the order is confirmed and are set out in the Shipping Policy.

Cool Kids Audio reserves the right to change its prices at any time. Products are invoiced at the price in force at the time the order is confirmed.

4. Ordering and Formation of the Contract

Orders are placed online. The process includes the following steps: selecting products and adding them to the cart, reviewing the cart details, logging in or creating an account, entering the delivery and billing addresses, choosing the delivery method, accepting these Terms of Sale, then payment.

Before confirming, the customer can review the details of their order and its total price and correct any input errors, in accordance with Article 1127-2 of the French Civil Code.

The sale is definitively concluded once payment is confirmed. A confirmation email summarizing the order is sent to the customer; it serves as acknowledgment of receipt. Cool Kids Audio keeps a copy of the contract.

Cool Kids Audio reserves the right to refuse or cancel an order in the event of a prior dispute with the customer, suspected fraud, or a manifest error regarding the price or availability of a product. In the event of cancellation by Cool Kids Audio, all sums already paid are fully refunded.

5. Payment

Payment is made online, by the means offered at checkout (notably bank card via Shopify Payments). Payment data is processed directly by the secure payment provider: Cool Kids Audio never has access to the customer's full banking data.

The customer warrants that they have the necessary authorization to use the chosen payment method. The order is processed only once payment has actually been received.

6. Delivery, Lead Times and Transfer of Risk

Orders are shipped to the address provided by the customer. Served areas, methods, costs and lead times are set out in the Shipping Policy, which forms an integral part of these Terms of Sale.

In accordance with Article L216-1 of the French Consumer Code, Cool Kids Audio delivers the goods no later than 30 days after the conclusion of the contract, unless a different period has been agreed. In the event of failure, the customer has the rights provided in Articles L216-6 and L216-7 (formal notice to deliver, then termination of the order and refund).

In accordance with Article L221-15, Cool Kids Audio is automatically liable towards the consumer customer for the proper performance of delivery, including when it is entrusted to a third-party carrier. The customer has no steps to take with the carrier.

The transfer of the risk of loss or damage occurs when the customer physically takes possession of the goods (Article L216-4). The procedures for receipt, reservations and handling of damaged or lost parcels are detailed in the Shipping Policy.

For deliveries outside the European Union (European countries outside the EU ordered directly on the store, or other destinations accepted on a case-by-case basis), customs duties, local taxes and import fees remain the customer's responsibility. No such fees apply to deliveries within the European Union.

7. Right of Withdrawal

The consumer customer has a period of 14 days from receipt of the goods to exercise their right of withdrawal without having to give a reason or bear any penalty, in accordance with Article L221-18 of the French Consumer Code.

The full terms (how to notify the decision, return period and costs, refund including outbound shipping costs at the standard rate, model form, condition of the goods and the exceptions of Article L221-28) are described in the Return and Refund Policy, which forms an integral part of these Terms of Sale. The original packaging is not required to exercise this right.

8. Legal Guarantees

Independently of any commercial guarantee, all products sold by Cool Kids Audio benefit from the following legal guarantees, at no cost to the customer.

8.1 Legal Guarantee of Conformity (Articles L217-3 et seq. of the French Consumer Code)

• The customer has 2 years from delivery of the goods to take action.
• Any lack of conformity appearing within 24 months of delivery is presumed to have existed at the time of delivery (Article L217-7). For second-hand or refurbished goods, this presumption period is reduced to 12 months, of which the customer is expressly informed by this clause and by the notice on the product page.
• The customer chooses between repair and replacement of the goods, free of charge (Article L217-9). Failing that, they may obtain a price reduction or termination of the sale (Articles L217-10 et seq.).
• Goods repaired under the legal guarantee of conformity benefit from a 6-month extension of that guarantee; in the case of replacement, a new period begins (Article L217-13).

8.2 Legal Guarantee Against Hidden Defects (Articles 1641 et seq. of the French Civil Code)

The customer may take action within 2 years of discovering the defect (Article 1648) and choose between returning the goods for a full refund, or keeping the goods for a partial refund of the price (Article 1644).

8.3 Implementation and Commercial Guarantee

To invoke any of these guarantees, the customer contacts victor@coolkidsaudio.com. The detailed procedures are set out in Part 5 of the Return and Refund Policy. Some manufacturers also offer their own commercial guarantee, which is in addition to the legal guarantees and never replaces or limits them; its terms are those of the manufacturer concerned.

9. Liability

Cool Kids Audio cannot be held liable for indirect damages resulting from the use of the products or the website. Nothing herein limits the liability of Cool Kids Audio under the legal guarantees (article 8), conformity, or the proper performance of delivery (article 6).

The liability of Cool Kids Audio cannot be engaged in the event of force majeure or an event beyond its control.

10. Consumer Mediation

In accordance with Articles L611-1 et seq. and R612-1 et seq. of the French Consumer Code, the consumer customer has the right to use a consumer mediator free of charge to seek an amicable resolution of any dispute with Cool Kids Audio.

The customer may refer the matter to the mediator after first attempting to resolve the dispute directly with Cool Kids Audio by written complaint, and within a maximum of one year from that complaint.

11. Intellectual Property

All content on the website coolkidsaudio.com (texts, images, logos, videos, graphic elements) is protected by intellectual property laws. Any reproduction or use without prior written authorization is prohibited.

12. Personal Data

Personal data collected in connection with orders or use of the website is processed in accordance with the Privacy Policy.

13. Governing Law and Disputes

These Terms of Sale are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action, where applicable through consumer mediation (article 10). Failing an amicable agreement, the French courts will have jurisdiction under ordinary law.
