Terms and Conditions of Sale

These Terms and Conditions of Sale (T&Cs) govern sales made on the website https://coolkidsaudio.com, operated under the commercial name “Cool Kids Audio” by Boring Vic SAS.

They apply to any order placed on the website. Before confirming an order, the customer declares that they have read and accept these T&Cs. This acceptance is confirmed by a checkbox at the time of order.

2. Products

The products offered for sale are those presented on the website on the day the customer views it, subject to available stock.

Cool Kids Audio strives to present products as accurately as possible. Photographs and visuals are for illustration; minor differences (shade, accessories shown for context) do not engage Cool Kids Audio's liability, subject to the legal guarantees of conformity referred to in Article 8.

3. Prices

Prices shown on the website are in euros (€), all taxes included, excluding shipping costs.

Applicable shipping costs are shown to the customer before the order is confirmed and set out in the Shipping Policy.

Cool Kids Audio reserves the right to change its prices at any time. Products are invoiced on the basis of the price in force when the order is confirmed.

4. Order and formation of the contract

Orders are placed online. The process includes the following steps: selecting products and adding to cart, reviewing the cart, signing in or creating an account, entering the delivery and billing address, choosing the delivery method, accepting these T&Cs, then payment.

Before confirming, the customer can review the details of their order and its total price and correct any input errors, in accordance with Article 1127-2 of the French Civil Code.

The sale is definitively concluded upon payment confirmation. A confirmation email summarising the order is sent to the customer and serves as acknowledgement of receipt. Cool Kids Audio keeps a copy of the contract.

Cool Kids Audio reserves the right to refuse or cancel an order in the event of a prior dispute with the customer, suspected fraud, or an obvious error concerning the price or availability of a product. If it cancels of its own initiative, Cool Kids Audio refunds in full any sums already paid.

5. Payment

Payment is made online, by the means offered at the time of order (in particular by bank card via Shopify Payments). Payment data is processed directly by the secure payment provider: Cool Kids Audio never has access to the customer's full banking data.

The customer warrants that they hold the necessary authorisations to use the chosen means of payment. The order is only processed after the payment has actually been collected.

6. Delivery, times and transfer of risk

Orders are shipped to the address indicated by the customer. Served areas, methods, costs and times are set out in the Shipping Policy, which forms an integral part of these T&Cs.

In accordance with Article L216-1 of the French Consumer Code, Cool Kids Audio delivers the goods no later than 30 days after the conclusion of the contract, unless a different period is agreed. In the event of a breach, the customer has the rights provided for in Articles L216-6 and L216-7 (instruction to deliver, then termination of the order and refund).

In accordance with Article L221-15, Cool Kids Audio is automatically liable, towards the consumer customer, for the proper performance of delivery, including when it is entrusted to a third-party carrier. The customer has no steps to take with the carrier.

The transfer of the risk of loss or damage occurs when the customer physically takes possession of the goods (Article L216-4). The arrangements for receipt, reservations and handling of damaged or lost parcels are detailed in the Shipping Policy.

For deliveries outside the European Union that may be accepted on a case-by-case basis, customs duties, local taxes and import charges remain the customer's responsibility. No such charges apply to deliveries within the European Union.

7. Right of withdrawal

The consumer customer has 14 days from receipt of the goods to exercise their right of withdrawal, without having to give reasons or incur any penalty, in accordance with Article L221-18 of the French Consumer Code.

The full arrangements (how to notify the decision, return time and costs, refund including outbound shipping at the standard rate, model form, condition of the goods and the exceptions of Article L221-28) are described in the Refund & Return Policy, which forms an integral part of these T&Cs. Original packaging is not required to exercise this right.

8. Legal guarantees

Independently of any commercial warranty, all products sold by Cool Kids Audio benefit from the following legal guarantees, at no cost to the customer.

8.1 Legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code)

• The customer has 2 years from delivery of the goods to act.
• Any lack of conformity appearing within 24 months of delivery is presumed to have existed at the time of delivery (Article L217-7). For second-hand or refurbished goods, this presumption period is reduced to 12 months, of which the customer is expressly informed by this clause and by the mention on the product page.
• The customer chooses between repair and replacement of the goods, free of charge (Article L217-9). Failing that, they may obtain a price reduction or rescission of the sale (Articles L217-10 et seq.).
• Goods repaired under the legal guarantee of conformity benefit from a 6-month extension of that guarantee; in the event of replacement, a new period runs (Article L217-13).

8.2 Legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code)

The customer may act within 2 years of discovering the defect (Article 1648) and choose between returning the goods for a full refund, or keeping the goods for a partial refund of the price (Article 1644).

8.3 Implementation and commercial warranty

To invoke one of these guarantees, the customer contacts victor@coolkidsaudio.com. The details of the arrangements are set out in Part 5 of the Refund & Return Policy. Some manufacturers additionally offer their own commercial warranty, which is added to the legal guarantees without ever replacing or limiting them; its terms are the manufacturer's responsibility.

9. Liability

Cool Kids Audio cannot be held liable for indirect damage resulting from the use of the products or the website. Nothing in these terms limits Cool Kids Audio's liability under the legal guarantees (Article 8), conformity, or the proper performance of delivery (Article 6).

Cool Kids Audio's liability cannot be engaged in the event of force majeure or an event beyond its control.

10. Consumer mediation

In accordance with Articles L611-1 et seq. and R612-1 et seq. of the French Consumer Code, the consumer customer has the right to free recourse to a consumer mediator with a view to the amicable resolution of a dispute with Cool Kids Audio.

The customer may refer the matter to the mediator after having tried to resolve the dispute directly with Cool Kids Audio by a written complaint, and within a maximum of one year from that complaint.

11. Intellectual property

All content on the website coolkidsaudio.com (texts, images, logos, videos, graphic elements) is protected by intellectual property laws. Any reproduction or use without prior written authorisation is prohibited.

12. Personal data

Personal data collected in connection with orders or use of the website is processed in accordance with the Privacy Policy.

13. Governing law and disputes

These T&Cs are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action, where applicable through consumer mediation (Article 10). Failing an amicable agreement, the French courts shall have jurisdiction under the conditions of ordinary law.
